Site Terms & Conditions
In addition to the auction-specific terms listed for each individual auction, the following terms will apply to ALL auctions:
As-Is, Where-Is
All sales are final and ALL ITEMS are SOLD IN THEIR “AS-IS—WHERE-IS” CONDITION. We offer many pictures of each firearm in our on-line catalog and an opportunity for inspection the day before each auction. If you have questions about a particular firearm, please call us as we are happy to help you. Auctioneer reserves the right, for any reason, to terminate, change, or suspend any aspect of any auction. All AMMO IS SOLD “AS-IS” WITH AN EXTREME EMPHASIS ON BUYER BEWARE.
Firearm Paperwork

For our Michigan buyers, your valid CPL or License to Purchase (LTP) is an exemption to the NICS background check, but you will still complete a 4473. If you purchase a handgun and do not have a CPL, you are required to have a License to Purchase (LTP) for each handgun (which is valid for 30 days) and can be obtained from any Michigan local law enforcement agency prior to taking possession of your handgun. If you purchase a long gun and do not have either license, you will be required to pass a NICS background check. A background check is not required for lots labeled antique or black powder. A 4473 is not required if you have an FFL, or if you have a Curio and Relics License (C&R) and the firearm is more than 50 years old. Two Alpha Auctions attempts to include whether a lot is eligible for C&R License in lot description. Trigger locks are available for all firearms.

Out-of-state buyers will be able to purchase and leave with any long gun(s) purchased, provided that they pass a NICS background check. Handguns purchased by out-of state buyers are required to be shipped to a Federal Firearms License holder in the buyer’s state unless you possess a Federal Firearms License and you provide us a copy of that license the day of the auction.

Online purchases cannot be picked up on auction day. Online purchases are required to be shipped to a Federal Firearms License holder in the buyer’s state. Michigan residents that purchase items online can either pick their purchases up at our Marshall location or have items shipped to a Federal Firearms License holder in their state.
Fee Terms

Sales Tax: A 6% Michigan sales tax is charged to all buyers purchasing items at the auction unless you are exempt from paying sales tax and provide us with a copy of your sales tax license. Purchases mailed to out-of-state buyers will not be charged sales tax. *Sales tax is calculated after Buyer’s Premium has been applied.*

Buyer's Premium: A Buyer's Premium will be added to all items purchased (this becomes part of the purchase price and will be reflected on bidder’s invoice). Please check each auction's terms for the buyer's premium percentage. Proxibid buyer’s premium is 18%, our website buyer’s premium is 13%, in-person bidding buyer’s premium is 10%.

Credit Cards: A 4% convenience fee is added to all credit card purchases.
Legal Courses of Action
Internet bids are a contract and you are responsible for honoring them. Every legal remedy available may be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend, and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs, and expenses including reasonable attorneys' fees and expenses related to, arising from, or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder.
Limit of Liability
In no event will our liability to a purchaser exceed the purchase price actually paid. Auction company cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error-free service or use of the site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. The auction company, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction or for any other reason. The decision of the auction company is final. Auctioneer is providing services as an independent contractor for the owner/seller only and is not responsible for statements made by other parties.
Bid Retraction
By placing a bid, bidder signifies that they have read and agree to all terms and conditions, and that their bid is a binding contract and bidder is required to pay for the item and abide by our posted terms.
Merchandise Removal or Forfeit
If a buyer does not pay for or pick up his/her items or arrange for shipping within 15 days, the auction company reserves the right to deem these items as abandoned and no refunds will be given. The auction company also reserves the right to charge reasonable storage fees for any items not collected within 15 days.
Assessment of Condition
Bidder's failure to inspect, or otherwise be fully informed as to the nature, quality, condition, quantity and size of any item will not constitute grounds for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale.
Auction Company’s Right to Suspend Bidding
Auction company may for any reason suspend a bidder's bidding privileges, without notice, if it is determined to be in the best interest of the auction company or the seller. A bidder's bidding privileges may be suspended or permanently terminated if the bidder provides false information when registering to bid. Auction company may also suspend bidding for any reason on an individual item or the entire auction.
Auction Company’s Right to Terminate Purchase
If for any reason Two Alpha Auctions is unable to complete the sale of any purchase to buyer or provide such purchase free and clear of liens, even if the buyer was given notice that he is the high bidder and purchaser, buyer agrees that Two Alpha Auctions may terminate the purchase/agreement, in which case Auction Company’s only liability shall be the return of any monies actually paid by buyer. This reason for termination would also include a missed reserve or minimum price or the seller's unwillingness to release said item. Auction Company also reserves the right to settle all disputes that may arise between bidders. In the event that the written description of a listed item is in contrast with (or is in any variation from) the pictures accompanying the auction listing, it is at the discretion of the Auction Company as to whether or not the sale will be completed or terminated.
Consent to Suit in Michigan
In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of Michigan. Buyer also agrees that venue shall be in Calhoun County, Michigan, and that the laws of the State of Michigan shall govern this Agreement and the parties' transaction hereunder.
